The Cy Pres doctrine permits class and defense counsel to recommend to judges, and permits judges to decide how, and to whom any residual settlement funds should be distributed, in lieu of returning unclaimed funds to settling defendants. Federal courts also may consider Cy Pres awards of unclaimed settlement funds. By California statute, Cy Pres funds can go directly to legal services organizations like Western Center.
